Terms of Service

Welcome to Hira! These Terms of Service ("Terms") govern your use of the Hira Labs Ltd. website, mobile app, and services ("Hira," "we," or "us"). By accessing or using Hira, you agree to comply with these Terms.
If you do not agree to these Terms, please do not use our services.
1. User Agreement
1.1 Eligibility: You must be at least 16 years old to use Hira. If you are between 16 and 18, you represent that you have permission from a parent or legal guardian to use Hira. By using our services, you represent and warrant that you have the legal capacity to enter into these Terms and comply with all applicable laws and regulations.
1.2 Account Creation: To use certain features of Hira, you may need to create an account. You are responsible for providing accurate and complete information during the registration process. You must also maintain the confidentiality of your account credentials and notify us immediately of any unauthorized use or suspected security breach.
2. Content and Intellectual Property
2.1 User Content: Hira allows you to create and store content such as journal entries and reflections. This content is private by default as we store it so you can access it, and we do not share it with other users. You retain ownership of any intellectual property rights that you hold in the content you submit.
By creating or storing content on Hira, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, store, and display that content solely to provide, operate, and improve our services. If we add features that let you share content, any content you choose to share may be visible to other users. We do not sell your content or use it to train AI models. We do not sublicense or transfer your content to third parties for their own use.
2.2 Prohibited Content: You agree not to upload, post, or share any content that violates applicable laws or regulations, infringes upon the rights of others, or contains offensive, defamatory, or inappropriate material. Hira reserves the right to remove or disable any content that violates these Terms.
2.3 Intellectual Property: Hira and its associated trademarks, logos, and materials are protected by intellectual property laws. You agree not to use any Hira intellectual property without our prior written consent.
2.4 Third-Party Services: Some features of Hira use third-party services (such as Apple Health, payment providers, and support tools). Use of those features is also subject to the terms and policies of the relevant third-party providers.
2.5 Subscriptions and Payments: Hira offers premium features by subscription. Subscriptions are billed through Apple or Google and are subject to their billing terms. Hira does not process or store your full payment card information for purchases processed by Apple or Google.
Payments are non-refundable except as required by law or as allowed by Apple or Google. You can cancel your subscription at any time through your device’s subscription settings. Price changes, if any, will be announced in advance.
2.6 License to Use the Services: Subject to your compliance with these Terms, Hira grants you a limited, non-exclusive, non-transferable, revocable license to access and use our services for your personal, non-commercial use. We reserve all rights not expressly granted to you.
2.7 Feedback: If you provide ideas, feedback, or suggestions about Hira, you agree we may use them without restriction or compensation.
3. Privacy and Data Protection
3.1 Data Collection and Use: We collect and process personal data in accordance with our Privacy Policy, which describes how we collect, use, disclose, and protect your information. By using Hira, you consent to the collection and processing of your personal data as outlined in the Privacy Policy.
3.2 GDPR Compliance: Hira complies with the General Data Protection Regulation (GDPR) and other applicable data protection laws. We implement appropriate technical and organizational measures to ensure the security and protection of your personal data.
3.3 No Professional Advice: Hira provides spiritual, religious, and devotional content for informational and reflective purposes only. Hira does not provide medical, psychological, legal, financial, or other professional advice. If you require authoritative religious guidance, consult qualified scholars. If you are experiencing distress or a mental health crisis, please seek professional help immediately.
4. Prohibited Conduct
When using Hira, you agree not to:
4.1 Violate any applicable laws, regulations, or third-party rights.
4.2 Use Hira to send spam, unsolicited messages, or engage in any form of unauthorized advertising or marketing.
4.3 Attempt to gain unauthorized access to Hira, user accounts, or computer systems.
4.4 Impersonate another person or entity or falsely represent your affiliation with a person or entity.
4.5 Engage in any activity that disrupts or interferes with the proper functioning of Hira.
4.6 Reverse engineer, decompile, or attempt to extract the source code of Hira.
4.7 Use automated means (such as bots or scrapers) to access Hira without our written permission.
4.8 Circumvent or attempt to circumvent any access controls, paywalls, or premium restrictions.
5. Termination
5.1 Termination by Us: We may suspend or terminate your access to Hira at any time for any reason, including but not limited to violation of these Terms. Upon termination, your right to use Hira will immediately cease, and you must cease all use of the platform.
5.2 Termination by You: You may stop using Hira at any time and delete your account through the app settings. Upon account deletion, your data will be processed in accordance with our Privacy Policy.
5.3 Effect of Termination: Upon termination (by you or us), you will lose access to your account and any content stored in it. When you delete your account, we will erase your personal data in accordance with our Privacy Policy and applicable law.
Once your data has been erased, we cannot provide copies. Active subscriptions will continue until the end of the current billing period unless cancelled by you. Refund requests must be directed to Apple or Google.
6. Limitation of Liability
6.1 To the extent permitted by applicable law, Hira and its affiliates, directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising out of or in connection with your use of Hira, including but not limited to loss of data, interruption of service, or any third-party conduct.
6.2 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law (including the Consumer Rights Act 2015).
6.3 We strive to provide accurate prayer times, translations, and other religious and spiritual content, including by consulting with people of knowledge. Nevertheless, we do not guarantee the accuracy of such content, and it is provided for informational and devotional purposes only.
6.4 Disclaimer of Warranties: The services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, secure, or error-free operation.
6.5 Cap on Liability: To the maximum extent permitted by law, Hira's total liability for any claim arising out of or related to these Terms or the services will not exceed the greater of £100 or the amount you paid to Hira for the services in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations; where that applies, these limitations apply to the maximum extent permitted.
6.6 Indemnification: You agree to defend, indemnify, and hold harmless Hira and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the services, (b) your content, or (c) your violation of these Terms or applicable law.
7. Modifications
We may update these Terms from time to time. We will post the updated Terms on our website and update the effective date. Material changes will be communicated to you (for example by email or in-app notice). Your continued use of Hira after the changes take effect means you accept the revised Terms. If you do not agree, you must stop using our services and may delete your account.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of United Kingdom.
You agree to attempt to resolve any dispute informally by contacting our support team at support@hira.app before initiating any formal proceedings.
9. General
If any part of these Terms is held to be invalid or unenforceable, the remaining parts will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hira regarding our services. If you access Hira through the Apple App Store or Google Play Store, you may also be subject to their respective terms and conditions.
